Die deutsche Regierung will in der ersten Jahreshälfte 2016 ein "Kulturgutschutzgesetz" verabschieden. Durch die im Entwurf vom 14.09.2015 beabsichtigten Regelungen wird das Sammeln von Naturgut (u. a. Fossilien, Mineralien) und Kulturgut (z. B. Münzen, Artefakte, Briefmarken, Kunstwerke) bedroht.

Sowohl private Sammler als auch Wissenschaftler, Händler und Messeveranstalter sind von gesetzlichen Verschärfungen der Einfuhrkriterien und einer Überbürokratisierung betroffen. Aus dem naturwissenschaftlichen Bereich wurde offenbar niemand in die Erarbeitung des Gesetzesentwurfs einbezogen. Auf diese Weise - und durch die Zusammenfassung mit völlig anderen Themenfeldern - sind viele nicht sachgerechte Regelungen in den Gesetzesentwurf gelangt.

Die angebliche Notwendigkeit zu der scharfen Regulierung wird mit Raubgrabungen, Antikenhandel und darauf basierender Terrorismusfinanzierung begründet. Niemand weiß, was naturwissenschaftliche Objekte damit zu tun haben und auch für den Bereich der klassischen Kulturgüter ist die Argumentation nicht belegt.

Sammlern, Wissenschaftlern und Händlern drohen
- unsinnige und nicht einhaltbare Einfuhrformalitäten bei jedem einzelnen Natur- und Kulturgut (ohne Wertgrenze),
bei Nichteinhaltung der Formalitäten Abrutschen des normalen internationalen Sammelns von Natur- und Kulturgut in die Illegalität und daraus resultierende Möglichkeit zur willkürlichen Enteignung privater Sammler,
- nicht einhaltbare Sorgfaltspflichten für Händler,
rechtsaatlich bedenkliche rückwirkende Regelungen und Beweislastumkehr,
- Behinderung der Naturwissenschaft durch Bürokratisierung und Entzug von Quellen für Forschungsgegenstände (Sammler, Händler, eigene Importe),
- der Wegfall von Messeveranstaltungen (wie Mineralien- und Fossilienbörsen).


Sammeln ist kein Beitrag zur Zerstörung von Kultur- und Naturgut, sondern entscheidend zu dessen Erhaltung! Wissenschaftler und Sammler kooperieren ausgezeichnet ("citizen science").

Wir fordern eine grundlegende Überarbeitung des Gesetzes unter Einbeziehung von Naturwissenschaftlern, privaten Sammlern und Händlern naturwissenschaftlicher Objekte, um zu sinnvollen Regelungen zu kommen! Auch die Kulturgutsammler müssen dringend nochmals ergebnisoffen angehört und einbezogen werden.

Naturgut ist Weltnaturerbe und nicht kulturelles Erbe eines Nationalstaats. Beschränkungen für den Warenverkehr, den internationalen Leihverkehr usw. sind nur für herausragende Einzelobjekte zu rechtfertigen, niemals pauschal für jedes beliebige Kultur- oder Naturgut.

International appeal to all collectors of natural and cultural objects – please sign the petition "For preserving the right to privately collect"!

 

The German government plans to pass a so called cultural goods protection bill in the beginning of 2016. A draft has been published on September 14th 2015 and menaces collecting of natural goods (such as fossils and minerals etc.) and cultural goods (including artifacts, coins, stamps, artworks etc.).

Private collectors as well as scientists, merchants and organisers of fairs would be adversely affected by this regulatory overreach. No one representing the natural sciences has been consulted during the draft phase of this pending law. By aggregating completely different resources (cultural goods and natural goods) within one act, many inappropriate and misguided regulations have found their way into the paragraphs.

Central to this proposed legislation, misinformed officials ludicrously attempt to justify the need for drastic regulations by argument of illicit digging and resulting illegal trade of artifacts ultimately being used for terrorist financing. This purported use of natural and cultural goods defies both logic and historical precedent in Germany.

 

Collectors, scientists and merchants are threatened by

- senseless import formalities which are impossible to observe for every single natural or cultural good (legislation currently makes no provision for waiving scrutiny of objects below a specified threshold value),

- the fact that non-compliance of the formalities would lead directly to classification of the possession of natural and cultural goods as being illegal, making it possible to criminalise collectors by more or less arbitrary acts by the authorities,

- proposed duties of care for dealers which are difficult or impossible to obtain,

- highly questionable retroactive law and reversal of evidence in account of the collector. (lack of "grandfather clause"),

- hindrance of natural science by excessive bureaucracy and deprivation of sources for new material (collectors, merchants and own imports),

- a virtual ban of international exchange and commerce of cultural and natural goods (e.g. fossil and mineral fairs) due to far to overwhelming and unnecessarily prohibitive bureaucratic requirements that have nearly the same effect as embargoes.

 

Collecting is not destruction of cultural and natural goods; it is quite the contrary: collecting is important to preserve natural and cultural goods for future generations! Scientists and collectors cooperate excellently in natural sciences ("citizen science").

 

We claim a fundamental revision of the law with inclusion of natural scientists, private collectors and merchants of natural objects to have input in proposing rules that make sense! The collectors of cultural goods need also to be heard, maybe leading to separate considerations for their pursuit.

 

Natural goods are world heritage and not the cultural heritage of a national state. Limitations for the merchandise traffic, for lending objects from institute to institute resulting from growing bureaucracy are not necessary for every single object; however, they may only be justifiable for certain objects above a meaningful and justifiable threshold value.

Le gouvernement allemand se propose d'adopter, au premier semestre de 2016, une "Loi sur la protection des biens culturels". Les dispositions du projet daté le 14 septembre 2015 menacent la collecte de biens naturels (y compris fossiles et minéraux) et de biens culturels (p.ex. des pièces de monnaie, artefacts, timbres et œuvres d’art).
Collectionneurs privés ainsi que scientifiques, commerçants et organisateurs d’expositions seront affectés par le resserrement législatif de critères d'importation et par des excès bureaucratiques.
Apparemment, la rédaction du projet de loi n’a pas bénéficié d’un concours de spécialistes en sciences naturelles. C’est pourquoi - et par la combinaison de ce sujet avec des domaines complètement différents - de nombreuses dispositions inappropriées ont pu se glisser dans le projet de loi.
Afin de justifier la nécessité d’une réglementation renforcée, on invoque la lutte contre des fouilles illégales, le trafic illicite de biens culturels et le financement du terrorisme. Cette logique n’est absolument pas applicable aux biens naturels ; même pour les biens culturels classiques, elle manque de cohérence.


Collectionneurs, scientifiques et commerçants sont menacés par


- des formalités d'importation absurdes et impossibles à respecter, pour chacun des biens naturels et culturels (sans égard à la valeur)

- des poursuites judiciaires, y compris l'expropriation arbitraire de collectionneurs privés de biens naturels et culturels, en cas de non-respect des formalités

- des obligations irréelles pour des commerçants, et impossibles à remplir

- des règlementations à caractère rétroactif (non justifiables en droit) et une inversion de la charge de preuve

- l’obstruction des sciences naturelles par la bureaucratisation et le retrait de matériel pour les objets de recherche (collectionneurs, marchands, importations personnelles)

- la suppression de foires commerciales (comme des bourses aux minéraux et fossiles).
Collectionner ne contribue pas à la destruction de biens culturels et naturels, mais est une activité indispensable à leur préservation. Scientifiques et collectionneurs coopèrent de façon remarquable.

 

Nous demandons une révision fondamentale du projet de loi, grâce au concours de scientifiques, de collectionneurs privés et de marchands d'objets scientifiques, afin d'arriver à des règlementations judicieuses. Il est urgent que les collectionneurs culturels soient également entendus et impliqués encore une fois, sans anticipation de résultat.
Le patrimoine naturel est mondial par définition, bien différent du patrimoine culturel d’un Etat. Des restrictions de la circulation des marchandises, des prêts internationaux etc. ne peuvent être justifiées que pour des objets spécifiques et d’une importance exceptionnelle, mais jamais de façon globale pour tout bien culturel ou naturel.

De Duitse overheid is van plan om in het begin van 2016 een wetsvoorstel door te voeren om zogezegd cultureel erfgoed te beschermen. Een draft van dit voorstel is gepubliceerd op 14 september 2015, en bedreigt het verzamelen van naturalia (fossielen, mineralen, etc.), en culturele objecten (waaronder artefacten, munten, postzegels, kunst, etc.)

Zowel private verzamelelaars als wetenschappers, handelaars en beursorganisatoren zouden worden benadeeld bij deze overregulering. Vanuit de natuurwetenschappen is geen enkele representatieve organisatie gekend geweest bij de opmaak van dit wetsvoorstel. Door compleet verschillende objecten (culturele objecten en naturalia) op één hoop te gooien in één wetsvoorstel, hebben veel onaangepaste en misleidende regels hun weg gevonden naar de teksten.

Centraal in het voorstel staat een poging -van slecht geïnformeerde officials- om drastische maatregelen door te voeren met het argument om illegale opgravingen en handel ten dienste van terroristische organisaties, te ontmoedigen. Dit veronderstelde gebruik houdt geen steek en kent nauwelijks precedenten in Duitsland.

Verzamelaars, wetenschappers en handelaars zouden worden onderworpen aan zinloze import formaliteiten, die onmogelijk te organiseren zijn voor elk individueel object (het voorstel maakt momenteel geen gewag van het afzien van deze regel vanaf een bepaalde ondergrens van de waarde). Het feit dat non-conformiteit automatisch leidt tot het beschouwen van het bewuste object als illegaal, zet de poort wagewijd open voor autoriteiten om verzamelaars op arbitraire wijze te criminaliseren, terwijl het moeilijk tot onmogelijk is om aan de vereisten te voldoen. Bovendien zou de wet met terugwerkende kracht gelden, en wordt de bewijslast volledig bij de verzamelaar gelegd. Om niet te spreken van het hinderen van wetenschappelijk onderzoek door overdreven bureaucracy en het onmoedigen van het verzamelen van nieuw materiaal. Dit is virtueel gelijk aan een effectief embargo op fossielen.

Verzamelen staat volgens ons niet gelijk aan het vernietigen van natuurlijk of cultureel erfgoed, wel integendeel. Het is een belangrijk aspect in de vrijwaring en conservering van dit erfgoed voor toekomstige generaties! Wetenschappers en verzamelaar kennen binnen de natuurwetenschappen een traditie van goede samenwerking ("citizen science" ).

We pleiten voor een fundamentele revisie van het wetsvoorstel, waarbij natuurwetenschappers, verzamelaars en handelaren gekend zijn en inspraak hebben, om tot een regelgeving te komen die voor iedereen steek houdt! Ook de verzamelaars van culturele objecten dienen hierbij gehoord te worden, wat wellicht kan leiden tot aparte aanpassingen aan hun behoeften.

Natuurlijk erfgoed is werelderfgoed, en behoort niet tot het cultureel erfgoed van één bepaalde natie of staat. Beperkingen tot handel, tot uitwisselen van materiaal tussen instituten door toenemende bureaucratie zijn niet nodig voor elk object. Desondanks erkennen we dat dit wel zinvol kan zijn voor bijzondere en waardevolle objecten.

Neem aub even de tijd om deze petitie "om het recht op private verzamelingen te vrijwaren" te tekenen.

Met elke stem neemt de druk op beleidsmakers toe om op een geïnformeerde en weloverwogen manier te handelen! We rekenen op de solidariteit van alle verzamelaars van natuurlijke en culturele objecten, en van wetenschappers die hierop onderzoek doen.

El Gobierno alemán quiere adoptar una “Ley para la Protección del bien cultural”, prevista para el primer semestre del año 2016. A través de los reglamentos contenidos en el proyecto de ley de fecha 14.09.2015, se pone en riesgo la colección de bienes naturales (entre otros, fósiles, minerales) y culturales (p.ej. monedas, artefactos, sellos postales, obras de arte)

Tanto coleccionistas privados como también científicos, comerciantes y organizadores de ferias se afectarán por el endurecimiento en las normativas de los criterios de importación y por la burocratización desproporcionada. Al parecer, nadie del campo de las ciencias naturales ha sido  vinculado en la elaboración del proyecto de ley.
De esa manera, y a través del resumen con otras áreas de trabajo completamente diferentes, se han incluido en el proyecto de ley reglamentos inapropiados.

La aparente necesidad de una regulación más estricta se argumenta mediante el robo de yacimientos arqueológicos, comercio de antigüedades, y a través del financiamiento al terrorismo, basado en dicho comercio. Nadie sabe qué tiene que ver con ese tema los objetos científicos. Esta argumentación tampoco se justifica para el área de los bienes culturales clásicos.

Coleccionistas, científicos y comerciantes se tendrán que enfrentar a:


- Procedimientos de importación, engorrosos y pocos factibles, de cada uno de los bienes naturales y culturales (sin límite de valor).

- En caso de incumplimiento de los procedimientos, se corre el riesgo de pasar de la colección normal internacional de bienes naturales y culturales a la ilegalidad, de la cual podría resultar la arbitraria expropiación de colección privada.

- Diligencias obligatorias para los comerciantes que son difícil o imposibles de obtener.

- Entorpecimiento de las ciencias naturales por la burocracia excesiva y la privación de fuentes de material nuevo (coleccionistas, comerciantes y las importaciones propias

- Eliminación de ferias temáticas como la Bolsa de Minerales y de Fósiles.

Coleccionar no contribuye a la destrucción del bien patrimonial, al contrario, favorece a su preservación! Científicos y coleccionistas cooperan perfectamente ("citizen science").

Exigimos una reformulación fundamental de la ley en la que se involucren a científicos, coleccionistas privados y a comerciantes de objetos científicos, a los fines de alcanzar una adecuada regulación. Consideramos, asimismo, que los coleccionistas de bienes culturales deben ser igualmente vinculados en dicha reformulación.

El bien natural es un patrimonio de la humanidad y no un patrimonio cultural de una Nación. Limitaciones para el tránsito de mercancía y para el tránsitos internacional de mercancía en carácter de préstamo, entre otro,  sólo se justifica para objetos únicos y no para cualquier bien natural y cultural.

Por  favor tómense unos minutos de tiempo y firmen la Petición para “Conservar el derecho del coleccionista privado”

O governo Alemão quer adotar uma „lei para a proteção de bens culturais. Através dos regulamentos contidosno projeto de lei de 14.09.2015, se põe em risco a coleção de bens naturais (entre outros Fósseis e minerais) e bens culturais (como Moedas, Artefatos, Selos postais e obras de arte).
Tanto colecionadores privados como também cientistas, comerciantes e organizadores de feiras serão afetados com o endurecimento dos critérios de importação e uma superburocratização. Aparentemente ninguém da área de ciências naturais, foi incluído no desenvolvimento do projeto de lei. Desta forma, e através do resumo com temas de áreas de trabalho completamente diferentes, regulamentos inadequados incluem-se ao projeto de lei.
A suposta necessidade de uma regularização acentuada é argumentada mediante roubo de escavação arqueológica, comércio de antiguidades e baseado nesse comércio o financiamento de terrorismo. Ninguém sabe, o que isso tem a ver com objetos de ciências naturais. Essa argumentação também tampouco se justifica com o ramo dos bens culturais clássicos.

Colecionadores, cientistas e comerciantes estão ameaçados a:
- Formalidades de importação sem sentido e sem possibilidades de cumprimento sobre cada um dos bens Naturais assim como Culturais.
- No caso de descumprimento dessas formalidades o colecionador international de bens culturais e naturais caem na ilegalidade e a partir disso a possibilidade arbitrária da expropriação da coleção privada,
- diligencias obrigatórias, impossíveis de cumprimento para comerciantes
- Regulamentos retroativos constitucionalmente questionáveis e reversão de ônus da prova,
- Delimitação das ciências naturais através de burocratização e retirada de fontes de novos objetos de pesquisa (Colecionador, comerciante e importações próprias)
- Eliminação de feiras temáticas (como bolsas de Minerais e fósseis).


Colecionar não é colaboração para a destruição de patrimônios culturais e naturais, ao contrário, é decisivo para o sua preservação! Cientistas e colecionadores cooperam perfeitamente („citizen science“).
Nós exigimos uma revisão fundamental da lei, envolvendo cientistas, colecionadores privados e comerciantes de objetos científicos naturais, para o alcance de regulamentos adequados! Os colecionadores de bens culturais também devem ser urgentemente e abertamente escutados e vinculados.
Patrimônio natural é patrimônio da humanidade e não herança cultural de uma nação. Limitações para o trânsito de mercadorias, e para o trânsito de mercadorias em caráter de empréstimos entre outros, somente se justifica para objetos únicos e nunca como montante fixo para qualquer bem cultural ou natural.

Il governo tedesco ha in programma di far passare una cosiddetta legge di protezione dei beni culturali all'inizio del 2016.
Una prima proposta della legge è stata pubblicata il 14 settembre 2015 e minaccia la ricerca e la raccolta di beni naturali (come i fossili ed i minerali, ecc) e dei beni culturali (tra cui manufatti, monete, francobolli, opere d'arte ecc.).

I collezionisti privati ??così come gli scienziati, i commercianti e gli organizzatori di fiere verrebbero bloccati da questo ingiusto regolamento.
Nessun rappresentante delle scienze naturali è stato consultato durante la fase di ideazione di questa proposta di legge. Aggregando completamente diverse discipline (beni culturali e beni naturali) in un unico atto, molti regolamenti, inappropriati e fuorvianti, sono all'interno dei vari paragrafi della legge.

L'intento di questa proposta di legge, i funzionari male informati, hanno tentato attraverso un testo scritto male la necessità di una regolamentazione drastica riguardante l'attività di scavi illeciti e conseguente commercio illegale di manufatti, che potrebbero, in ultima analisi, essere utilizzati per il finanziamento del terrorismo.
Questo uso presunto di beni naturali e culturali sfida sia la logica che i precedenti storici in Germania.

Collezionisti, scienziati e commercianti sono minacciati da:

- Varie formalità di importazione insensate che sono impossibili da osservare per ogni singolo bene naturale o culturale (la legislazione vigente non prevede un controllo di oggetti che possiedono un valore al di sotto di una soglia specificata),

- il mancato rispetto delle formalità porterebbe direttamente alla classificazione del possesso di beni naturali e culturali in una situazione illegale, che permetterebbe di criminalizzare i collezionisti da atti più o meno arbitrari da parte delle autorità,

- Proposta di obblighi di diligenza per i concessionari che sono difficili o impossibili da ottenere,

- Legge retroattiva molto discutibile e l'inversione delle prove a carico del collezzionista. (mancanza della "clausola del nonno"),

- Ostacolo allo sviluppo delle scienze naturali da un eccesso di burocrazia e la privazione di fonti per nuovi materiali (collezionisti, mercanti e gli scambi culturali fra i vari musei e/o enti),

- Il divieto virtuale di scambio internazionale e del commercio di beni culturali e naturali (ad esempio, fossili e minerali nelle fiere) dovute al rispetto a requisiti burocratici opprimenti e inutilmente proibitivi che hanno quasi lo stesso effetto di embarghi o divieti.


La raccolta non è distruzione dei beni culturali e naturali; è proprio il contrario: la raccolta è importante perchè preserva i beni naturali e culturali per le generazioni future! Scienziati e collezionisti cooperano ottimamente nel campo delle scienze naturali in Germania ("la scienza è dei cittadini").

Chiediamo una revisione fondamentale del testo di legge, con il supporto degli studiosi delle scienze naturali, collezionisti privati e commercianti di scienze naturali per poter proporre regole che abbiano senso! I collezzionisti dei beni culturali devono anche essere ascoltati, forse portando a separare i campi che sono distinti come considerazione finale.

I Beni naturali sono patrimonio dell'umanità e non il patrimonio culturale di un unico Stato nazionale. Limitazioni per lo commercio, per il prestito di oggetti da istituto a istituto derivante dalla crescente burocrazia non sono necessari per ogni singolo oggetto; tuttavia, possono essere solo giustificati per determinati oggetti dotati di valore sia scientifico e economico oltre una certa soglia predefinita.

Dette gælder også for messer (såsom mineralske og fossile fondsbørser).

Правительство Германии намерено принять в первом полугодии 2016 года так называемый «Закон об охране культурного достояния». Положения, предложенные в проекте от 14.09.2015 г., угрожают коллекционированию природных материалов (в
том числе окаменелостей, полезных ископаемых, минералов) и предметов
культурного достояния (включая монеты, экспонаты, почтовые марки, произведения
искусства и т. д.).


Как частных коллекционеров, так и ученых, продавцов и организаторов выставок-
ярмарок затронет ужесточение законодательства относительно критериев импорта, а
также чрезмерные бюрократические нововведения. Никто из экспертов в области
естественных наук, по-видимому, не был вовлечен в разработку этого законопроекта.
Объединение абсолютно различных категорий объектов коллекционирования
(предметов культуры и искусства с природными материалами) в рамках одного
правового акта, вносит в параграфы данного законопроекта множество
несоответствующих и дезинформирующих инструкций.
Главная проблема, которую создает предложенный законопроект, заключается в том,
что дезинформированные чиновники пытаются оправдать необходимость исполнения
различных разрешительных инструкций нелепыми аргументами, что, дескать,
незаконные раскопки и контрабанда найденных экспонатов, в конечном счете, могут
быть использованы для финансирования терроризма. Это предполагаемое незаконное
использование природных материалов и предметов искусства и культуры создает
прецедент, бросая вызов логике и историческим традициям Германии.


Коллекционерам, ученым и продавцам теперь грозят:


– соблюдение бессмысленных и бесконечных формальностей при импорте каждой
отдельной единицы природных и культурных ценностей (без лимита стоимости);


– факт, что несоблюдение таких формальностей непосредственно приведет к тому, что
коллекции природных материалов и предметов культуры и искусства будут
классифицированы как незаконные, а самоуправство и произвол властей буквально
криминализируют коллекционеров;


– невозможность, в связи с новым законодательством, получить официальные
разрешительные документы дилерами, так как добиться их от чиновников будет
просто нереально;


– невозможность определить четкие критерии стоимости какого-нибудь объекта
природного происхождения в коллекции, так как таких расценок просто не
существует;


– бюрократические препоны в исследовательской работе научных сообществ и
институтов, лишающие эти заведения собственно предметов исследования, так как
частные коллекционеры, продавцы обязаны предоставить разрешительные документы
на их экспорт, что весьма затормозит процесс, а то и вовсе лишит возможности
обмениваться материалом;


– виртуальный, но фактический запрет на проведение онлайн-аукционов, выставок,
ярмарок (минеральные биржи и биржи окаменелостей), международного обмена и
торговли, так как собрать справки на каждый найденный камешек или ракушку
просто невозможно, и это, с точки зрения закона, становится незаконным, а потому на
все эти мероприятия будет наложено эмбарго.


Коллекционирование — это важный вклад в сохранение природного достояния и
культурного наследия, а не разрушение их! Коллекционирование играет огромную
роль в сбережении ценностей для будущих поколений! Ученые и коллекционеры
превосходно сотрудничают и взаимодействуют в области естественных наук (citizen
science).


Мы требуем фундаментального пересмотра закона с обязательным участием в
этом процессе ученых-натуралистов, частных коллекционеров и продавцов объектов
из природных материалов с целью определения четких правил, которые отвечают
здравому смыслу! Коллекционеры культурных ценностей также должны приобщиться
к процессу совершенствования данного законопроекта, что только улучшит результат.


Природные материалы — это всемирное наследие, а не просто культурное наследие
отдельно взятого национального государства. Ограничения при движении товаров,
предоставлении природных объектов одним институтом другому институту для
научных исследований и т. п. могут стать следствием нарастающей бюрократии и
вовсе не являются необходимыми для каждого объекта, однако вполне могут быть
допустимыми для определенных предметов и объектов, превышающих пороговое
значение ценности.

Пожалуйста, найдите минуту времени, чтобы подписать петицию «За сохранение
права частного коллекционирования»!

Каждый ваш голос — на счету и увеличивает давление на политиков, чтобы те
прислушались к здравому смыслу! Мы надеемся на международную солидарность
всех коллекционеров природных материалов и предметов культуры и искусства, а
также всех ученых, продавцов, которые работают с этими объектами.
